01Agreement to these terms

These Terms of Use ("Terms") are an agreement between you and Vanguard Financial ("we," "us," or "our") covering your use of vanguardfinancial.co and any related pages, tools, or content (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

02Who may use this site

You must be at least 18 years old and legally able to enter into a contract to use the Site. The Site is intended for users located in the United States. We make no claim that the Site or its content is appropriate or available for use in other locations, and accessing it from elsewhere is your own responsibility, including compliance with local law.

03Not financial, insurance, tax, or legal advice

All content on the Site — including articles, calculators, sample premiums, policy illustrations, and general descriptions of products or strategies — is provided for informational and educational purposes only. It is general in nature and does not take into account your particular financial situation, objectives, health, or needs.

Nothing on the Site is:

• a recommendation to buy, sell, surrender, replace, or hold any insurance policy, annuity, or financial product;
• an offer or solicitation in any jurisdiction where that would be unlawful, or in any state where we are not licensed;
• tax, accounting, or legal advice; or

04No client, advisory, or fiduciary relationship

Using the Site, submitting a form, or contacting us does not create a client, advisory, or fiduciary relationship between you and Vanguard Financial. Such a relationship is formed only through a separate written agreement or a completed insurance application accepted by the issuing carrier. Please do not send confidential account information through the Site's contact forms or by unencrypted email.

05Insurance products, carriers, and licensing

Vanguard Financial is an independent insurance agency. We do not underwrite or issue policies. All coverage is underwritten and issued by the insurance carrier you apply to, and all rates, terms, benefits, riders, exclusions, and availability are set by that carrier and are subject to its underwriting review, product availability in your state, and the terms of the policy actually issued.

No quote, illustration, or statement on the Site or from any representative binds coverage. Coverage begins only when the carrier issues the policy and its conditions for taking effect have been met. Products and services are offered only in states where Vanguard Financial and the applicable representative are properly licensed.

Vanguard Financial is not affiliated with, endorsed by, or connected to The Vanguard Group, Inc., or to any government agency.

06Acceptable use

When using the Site, you agree not to:

• break any law or regulation, or use the Site for fraud or money laundering;
• impersonate another person or misrepresent your identity or authority, or submit a phone number that is not yours;
• attempt to access accounts, systems, or data you are not authorized to access;
• introduce malware, or interfere with the Site's operation or security;
• scrape, harvest, or copy content in bulk, or use automated tools without our written permission; or
• reproduce, resell, or redistribute Site content for commercial purposes.

07Accuracy and availability

We work to keep the Site accurate and current, but we do not guarantee that it is. Rates, terms, product details, and third-party data may change without notice, and errors or omissions may occur. We may modify, suspend, or discontinue any part of the Site at any time without liability to you.

08Third-party links and content

The Site may link to websites, tools, or content we do not control, including carrier websites and application portals. We provide those links for convenience only. We do not endorse and are not responsible for third-party content, products, or privacy practices. Once you leave the Site, the terms and privacy policy of the destination site apply.

09Our content and trademarks

The Site and its content — text, graphics, logos, design, and software — are owned by Vanguard Financial or its licensors and are protected by copyright, trademark, and other laws. You may view, download, and print pages for your own personal, non-commercial use, as long as you keep all notices intact. All other rights are reserved.

10Electronic communications

By using the Site or giving us your contact information, you consent to receive communications from us electronically, including notices and disclosures. You agree that electronic records and signatures satisfy any legal requirement that such communications be in writing.

11Calls and text messages

If you give us your phone number through the callback form or otherwise, you are asking us to contact you at that number about your inquiry, and you agree that we may do so. You represent that the number is yours and that you are authorized to receive calls at it.

The text-message consent checkbox on our callback form is optional. It is not a condition of receiving a quote, obtaining information, or purchasing any policy, and declining it will not change the service you receive. If you do opt in, you agree to receive transactional and informational text messages from Vanguard Financial about your request — quote follow-ups, appointment reminders, and service updates. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. We do not share mobile numbers or opt-in consent with third parties for their marketing; see our Privacy Policy.

12Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VANGUARD FINANCIAL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR UNINSURED LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED $100.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits any right you have under an insurance policy against its issuing carrier.

14Indemnification

You agree to defend, indemnify, and hold harmless Vanguard Financial and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

15Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes take effect when posted, and your continued use of the Site means you accept the updated Terms. Please review this page periodically.

16Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree that any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and both parties consent to the jurisdiction of those courts.
